In New York State, if you die without a will (intestate), the Court will determine how your assets are distributed. If you have a will, it gives you the power to specifically allocate your assets to your loved ones. Also, having a will receives a lot of stress for loved ones as the probate process is much more streamlined when there is a will.
NO! You should never plead guilty to anything without first consulting an attorney. Traffic ticket may seem like a simple thing that is easier to pay than have to go to court for but the Traffic Court and the DMV have specific guidelines when it comes to traffic violations. For instance, if you commit three or more speeding violations within 18 months, your license will be revoked for 6 months. Also, If you accumulate 11 or more points within 18 months, your license can be suspended or revoked by the DMV. Having an attorney represent you will greatly improve your chances of receiving a lesser charge and reduced points.
You should contact an attorney as soon as you are served because you only have 20 days from the date of service to answer the summons. If you do not answer within that time, the Plaintiff may seek a default against you and request that a trial be held in your absence (inquest). If this happens, then you will not be afforded the opportunity to defend yourself and the Plaintiff will be awarded all the relief requested in their complaint.
